Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Whakatu rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

Whakatu Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory for all Whakatu and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standards that apply or will apply during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform according to Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Whakatu rental properties need to have a stable source of heat that can warm the{ main or largest|| largest or main| principal or the biggest} living room to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs to remain fixed (i.e., not portable), at least 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living space.
