Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Waipukurau rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

It is crucial to note that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are given for severe violations. Those who have six or more properties can be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Waipukurau Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Waipukurau and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with any Healthy Homes Standards that apply or will apply during the tenancy of your rental home.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Waipukurau rental properties must have a fixed source of heating that is able to heat the largest or main living room to at least 18degC even on the winter coldest days. If the main living room already has a fixed heating source such as heat pumps, it might just require an update to ensure it meets the requirements. Some types of heaters can’t be used to comply with the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.
