Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Waipukurau rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Tenancies established between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory in all Waipukurau and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable during the tenure of your rental home.

Starting 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Waipukurau

Waipukurau rental properties need to have a stable heating source that can heat the principal or the biggest living area to at minimum 18degC even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are required. In some instances, like small apartment buildings, a smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source like an air conditioner, it could need an update to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate or are unsafe to operate.
