Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed for a Waipukurau rental property, all Healthy Homes compliance tasks must be finished within 90 days.

It is also important to keep in mind that a landlord who own multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down only for serious violations. Those who have more than six properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Waipukurau Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required to all Waipukurau and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any renewal, new or a change in lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Waipukurau rental properties require a reliable source of heat that can heat the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.
