Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Twyford rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Twyford rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy contract, it could result in an additional fine or violation fee.

If the property manager fails to provide the necessary information within 21 days from receiving the request, they may be issued an infringement notice and be fined up to $750.

Additionally, there is an additional fine of up to $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the lease agreement as the one who is renting the property and it could be the name of the landlord or the company that manages the property.

It’s crucial to be aware that landlords who manage several rental properties can face even higher fines for non-compliance. The harshest penalties are given for severe breaches. Landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in hearing claims.

Tenancies that were signed beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Twyford and New Zealand rental homes where it is reasonably practicable to install.
