Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Te Mata Hills rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there may be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager fails to supply the information requested within 21 days of being informed of the request, they may receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or information. The person liable for this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property which could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be accurate when the tenancy agreement is executed, and it should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It is important to keep in mind that a landlord with multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for the most serious breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in hearings.

Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Te Mata Hills and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with each Healthy Homes Standard that apply or will be applicable during the tenure of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Te Mata Hills

Rental properties in Te Mata Hills need to have a stable source of heating that can heat the living room to at least 18degC, even during the most coldest days of the year.
