Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Te Mata rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

From the 1st of July in 2021, once a new, renewed or varied lease is entered into on the Te Mata rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager does not supply the information requested within 21 days of getting the notice, the tenant may receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is listed on the tenancy contract as the person who is letting the property, so it could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance requirements to be accurate when the tenancy contract is signed, and ideally it is updated throughout the tenancy as any necessary work related to it’s finished.

It’s also crucial to be aware that landlords with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given only for serious violations. Those who have more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

When will I require to meet The Healthy Homes Standards?

Te Mata Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory throughout Te Mata and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with all Healthy Homes Standard that apply or will be applied to the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Te Mata

Draughts are a major cause of lower temperatures in houses. A humid home is more expensive to heat, which means wasting energy and increased bills.

If a draught can be perceived as a result of gaps or holes or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a crack or a gap and you are able to feel it, it’s most likely a gap or an opening that needs sealing in somehow. The proper heating equipment is crucial for well-being homes

Heating Te Mata

Rental properties in Te Mata require a reliable heating source which can warm the largest or main living space to a minimum of 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) and at minimum 1.5 kW of heating capacity and have the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to determine if the existing fixed heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters aren’t considered to be suitable heating options under The Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), it should include the thermostat. This will make the heating more reliable and efficient. In most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a fixed heating source like the heat pump, it could require some additional energy to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Te Mata

Every living space in the rental property should have at least one opening windows or an exterior door to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens and bathrooms need to have an externally vented extractor fan to eliminate moisture.

The ventilation quality is all about recognising that dry air is less difficult to heat and an apartment that is well-ventilated is less likely to develop damp and mould.

Bedrooms, living rooms, dining rooms, and kitchens are considered to be liveable spaces. Connecting spaces such as the hallway are not considered liveable and don’t need an opening door or window.

Every window, door or the skylight requirements for them to be in a position to open to the outside, and stay closed, allowing the circulation of fresh air and ventilation.

All bathrooms and kitchens as well as any other space in your home with shower, bath or cooktop, or any other humidity-generating items will require adequate extractor fans that vent towards the outside. Insulation Te Mata

Underfloor and ceiling insulation is a requirement for all rent houses since 1 July 2019. All landlords and property managers have to make sure the insulation meets current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space might need to be replaced or replaced.

The security of your rental home from the effects of moisture isn’t just a matter of the inside of the building it is also about the outside. You must make sure there is somewhere to allow surface, rain or ground water, and prevent it from getting inside. When it comes to moisture and damp it’s usually those things that you aren’t aware of that can become a big problem and end up causing damage to your investment as well as affecting the tenant’s health.

Properties that are rented must be equipped with effective drainage to get rid of the stormwater and surface waters, and ground water, which includes an appropriate runoff or outfall. Making sure that the water is able to go and that it doesn’t sit beneath buildings is an essential part of keeping your property dry.

In addition to a drainage system to avoid moisture from entering, if your rental is enclosed between your floor and the ground, a ground moisture barrier should be put in place if it’s reasonably practicable to install it.

A ground moisture barrier is generally a sheet of polythene that is placed over the ground, in order to block any moisture in the ground from getting into the structure. It also assists in preventing from causing damage to the flooring insulation.
