Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Te Hauke rental property, all Healthy Homes compliance work must be finished inside of 90 days.

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Te Hauke rental property, all Healthy Homes compliance work must be finished within 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement, there may be an additional fine or violation fee.

Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t provide the information requested within 21 days from receiving the request, they could receive an infringement letter and be fined upto $750.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is named on the tenancy agreement as being the person letting the property out which could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be current before the tenancy agreement can be signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.

It is also crucial to remember that a landlord who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved only for serious breaches. Landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 for hearing claims.

Te Hauke Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is required in all Te Hauke and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Te Hauke

Draughts are a major cause of low temperatures inside houses. A cold home is more expensive to heat, which means wasting money and energy.

If a draught could be felt through gaps that are too large or holes or holes, it needs to be sealed.

Heating Te Hauke

Rental properties in Te Hauke require a reliable heating source that can heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements that it be permanently fixed (i.e., not portable) with at minimum 1.5 horsepower in capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool can be used to determine whether the existing fix heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters are not considered to be acceptable heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it must include an thermostat. This will make your heating more consistent and efficient. In most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings an electric, fixed heater may suffice.

If the main living room already has a fixed heating source, like the heat pump, it could need an upgrade to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Insulation for underfloor and ceilings is a requirement for all rent homes from 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with the new quality.
