Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Te Hauke rental property, all Healthy Homes compliance tasks must be done within 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Te Hauke rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to provide the information requested within 21 days from having received the inquiry, they will receive an infringement notice and be fined up to $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is the person who is identified on the tenancy agreement as being the person renting the property and it could be the name of the landlord as well as the company that manages the property.

Te Hauke Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Te Hauke and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with each Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
