Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Te Hauke rental property, all Healthy Homes compliance items need to be finished within 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on the Te Hauke rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

If the landlord or property manager is unable to supply the required information within 21 days from being informed of the request, they could be issued an infringement notice and be fined as high as $750.

In addition, there’s also a fine of up to $900 for property owners or property managers that provide false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is named on the tenancy agreement as the one who is letting the property out, so it could be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It should be kept updated through the tenancy period as related work is completed.

When should I need to be in compliance with my Healthy Homes Standards?

Te Hauke Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Te Hauke and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with any Healthy Homes Standards that apply or will apply to your rental home.

From July 1st 2021

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

For example, if the open fireplace isn’t in use it can cause draughts and should be blocked from. You don’t require to cover up gaps or holes in the building. Adequate heaters are crucial to ensure healthy houses

Heating Te Hauke

Rental properties in Te Hauke need to have a stable source of heat that is able to heat the largest or main living space to a minimum of 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

In some instances, like small apartment buildings, a smaller fixed electric heater may be sufficient.

If your living space already has a fixed heating source like a heat pump, then it may need a top up in order to comply with the standards. Some types of heaters can’t be used to comply with the standard as they are either expensive, inefficient or are unsafe to operate.

Ventilation Te Hauke

Every living space in a rental property has to contain at minimum one open door or window to provide natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms should have an venting fan outside to remove moisture.

It is the ventilation quality is about recognising the fact that dry air is less difficult to heat and heat, and a well ventilated rental property will be less prone to developing damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable spaces. Connecting spaces like the hallway aren’t considered living spaces and therefore don’t need an opening door or window.

Underfloor and ceiling insulation is mandatory on all rental homes from 1 July 2019. Property managers and landlords should ensure that the insulation is in line with current standard. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be replaced or replaced.
