Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Taradale rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days of getting the notice, the tenant may receive an infringement notice and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for landlords or property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the person who is named on the lease contract as the person renting the property and it could be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance needs to be accurate when the tenancy agreement is signed. It is updated throughout the tenancy as any necessary work related to it is finished.

It is also crucial to keep in mind that a landlord who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Taradale Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement in all Taradale and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Taradale

Rental properties in Taradale require a reliable source of heat that can warm the main or largest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to remain fixed (i.e., not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living room. For most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a permanent heating source, such as the heat pump, it might need an upgrade to meet the standards. Certain kinds of heaters cannot be used to comply with the quality since they’re either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Taradale

Insulation Taradale

Insulation for underfloor and ceilings is a requirement on all rental homes from 1 July 2019. Property managers and landlords have to ensure that the insulation is in line with this new standard. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may need to be added or replaced.
