Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Raupunga rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.

As of 1st July 2021, when a brand new or renewed Tenancy is signed for a Raupunga rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. The information contained in the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and is updated through the tenancy period as associated work has been completed.

It’s crucial to remember that landlords with multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down for the most serious violations. Those who have more than six properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Raupunga Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Raupunga and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records of their the compliance with any Healthy Homes Standards that apply or will be applicable to the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts are a major cause of lower temperatures in homes. A humid house will cost more to heat, which means wasting energy and resulting in higher bills.

Heating Raupunga

Raupunga rental properties need to have a stable source of heat that is able to heat the largest or main living space to a minimum of 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to be fixed (i.e., not portable), at minimum 1.5 horsepower in capacity and have the minimum heating capacity needed for the main living room. A Heating Assessment Tool can be used to determine whether your current permanent heater(s) are sufficient or if you’ll need to "top-up" with a new heater. Unflued combustion and open fire heaters like mobile LPG bottle heaters aren’t considered acceptable heating options in those following the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat source, it should be equipped with the thermostat. This will help make the heating more consistent and efficient. For most properties, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like small apartments the smaller fixed electric heater might be enough.

If your main living space already has a permanent heating source such as the heat pump, it may require a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Raupunga
