Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Raupunga rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on a Raupunga rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, there is also a penalty of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as being the person letting the property out which could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It must be updated throughout the duration of the tenancy when any associated work has been completed.

It’s important to remember that landlords with multiple rental properties could face even higher fines for non-compliance. The highest penalties are given for the most serious violations. Those who have six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies commenced between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory to all Raupunga and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their conformance with all Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply with the Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.
