Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Putorino rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.
From the 1st of July in 2021, if a new or renewed Tenancy is signed for a Putorino rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.
Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the information requested within 21 days from receiving the request, they will receive an infringement letter and be fined up to $750.
Additionally, there is also a penalty of up to $900 for landlords or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.
All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any necessary work related to it’s finished.
It’s important to keep in mind that a landlord who have multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.
