Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Putorino rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Putorino rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to supply the necessary information within 21 days from being informed of the request, they may receive an infringement letter and could be fined up to $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as the person who is letting the property out It could also be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy agreement is executed, and it should be maintained through the tenancy period as related work is completed.

It is important to note that landlords who manage multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down for serious breaches, and landlords with six or more properties can be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Putorino Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Putorino and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Putorino must have a fixed source of heat that is able to heat the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest days of the year.
