Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Putorino rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

If the landlord or property manager is unable to provide the information requested within 21 days from receiving the request, they will receive an infringement letter and be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any necessary work related to it’s finished.

It’s important to keep in mind that a landlord who have multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

When do I require to be in compliance with requirements of the Healthy Homes Standards?

Putorino Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement throughout Putorino and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will be applied during the tenancy of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

If the main living room already has a permanent heating source like the heat pump, it might need an upgrade to meet the standards. Certain kinds of heaters cannot be used to meet the standard because they’re costly, not affordable to run, and/or unhealthy to run.
