Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Putorino rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Putorino rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to supply the necessary information within 21 days of receiving the request, they will receive an infringement notification and be fined as high as $750.

Additionally, there is also a fine of up to $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is named on the lease agreement as the one who is who is letting the property It could also be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate when the tenancy agreement is executed, and it should be maintained through the tenancy period as necessary work related to it’s finished.

It’s also crucial to remember that a landlord who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for the most serious breaches. Landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Putorino Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required for all Putorino and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Putorino

Rental properties in Putorino must have a fixed source of heat which can warm the main or largest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.
