Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for a Pirimai rental property, all Healthy Homes compliance items have to be done by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on the Pirimai rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. It is important to note that a landlord who own several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Pirimai Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Pirimai and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

  • All rental homes must comply with the Healthy Homes Standard regardless of when the tenancy began.

What are the most unreasonable gaps or holes?

If you can feel external air entering or the air is clear from a gap or hole that is, it is most likely a gap or hole that needs sealing in somehow. Large cracks and gaps should be fixed permanently. The gaps that exceed 3mm that allow air in or out within your home require the sealing. For example, if the open fireplace is not in use, it can create draughts. This should be blocked off. Property managers and landlords are responsible for making sure such draughts are eliminated as far as possible.

There is no require to cover up holes or gaps which are part of the building. Rental properties in Pirimai should have a permanent source of heating which can warm the largest or main living area to at minimum 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

In most houses, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like apartments with small spaces an electric, fixed heater may be sufficient.

If the living area already has a fixed heating source, like a heat pump, then it could require an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Pirimai

Insulation Pirimai

Insulation for underfloor and ceilings is a requirement for all rent houses since 1 July 2019. All landlords and property managers must ensure the insulation meets current quality.
