Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Pirimai rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied Tenancy is signed for the Pirimai rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement it could result in additional penalties or an infringement fee.

All the information on the Compliance Statement requirements to be current before the tenancy agreement can be signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s also important to keep in mind that landlords who manage multiple rental properties could face additional fines for non-compliance. The harshest penalties are handed down for severe violations. Those who have at least six rental properties could be penalised up to $50,000, and as much as $100,000 in hearings.

Pirimai Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Pirimai and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with each Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform according to Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

If you are able to feel external air getting in, or see an unobstructed draught coming from a hole or gap that is, it’s most likely a gap or crack that requirements sealing in any way. For instance, if an open fireplace isn’t being used, it may cause draughts and should be blocked off. Adequate heaters are crucial to ensure healthy homes

Heating Pirimai

Pirimai rental properties should have a permanent heating source which can warm the living area to at minimum 18degC, even during the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs that it be permanently fixed (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed for the main living space. For most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like small apartments, a smaller fixed electric heater could be enough.

If the main living room already has a central heating source like a heat pump, then it might just need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality as they are either expensive, inefficient and/or unsafe to run.

Ventilation Pirimai

Ceiling and underfloor insulation is a requirement on all rental homes since 1 July 2019. All landlords and property managers have to make sure that the insulation meets this new quality.
