Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Parkvale rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on the Parkvale rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated in a new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the the property manager doesn’t supply the information requested within 21 days from being informed of the request, they could receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person liable for this fine is the one who is named on the tenancy agreement as being the person renting the property, so it could be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed. It must be updated throughout the tenancy as any necessary work related to it is finished.

It’s crucial to remember that a landlord with multiple rental properties may face even higher fines for non-compliance. The highest penalties are reserved for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

If you fail to adhere to the Healthy Homes requirements can hit your pocket hard, resulting in massive fines as well as still having to meet compliance. Don’t take a chance with your rental property Call us today and make arrangements to have an home inspection performed on your rental property.

If a draught could be noticed from gaps that are not adequate or holes, it requirements to be closed.

What are unreasonable gaps or holes?

If you can feel external air coming in or an unobstructed draught coming out of a hole or gap or crack, then it’s likely to be a gap or an opening that requirements sealing in any way. Cracks and gaps that are large should be permanently stopped. Cracks that are greater than 3mm and allow air to enter or exit within your home need to be sealed. For example, if an open fireplace isn’t used it could cause draughts, and must be sealed off. Property managers and landlords are accountable for ensuring that these draughts are stopped as far as imaginable.

You don’t require to cover up gaps or holes in the construction. A good heating system is important to ensure healthy homes

Heating Parkvale

Rental properties in Parkvale must have a fixed source of heating which can warm the living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e. not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool could be used to determine if the existing permanent heater(s) are sufficient or whether you will need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters like portable LPG bottle heaters are not considered to be safe heating options under the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump then it must include an thermostat. This will help make the heating more reliable and efficient. In most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, such as small apartments the smaller fixed electric heater might be enough.

If your main living space is already equipped with a fixed heating source such as heat pumps, it might just need some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality as they are either expensive, inefficient or unsafe to operate.

Ventilation Parkvale

Each liveable space in the rental property should include at least one open door or window to offer natural airflow. Furthermore, moist areas like kitchens and bathrooms need to have an venting fan outside to eliminate moisture.

A ventilation quality is all about acknowledging the fact that the dry atmosphere is more easy to heat and the property that is properly ventilated is less likely to be a victim of damp and mould.

Bedrooms, living rooms, kitchens and dining rooms are considered liveable areas. Spaces that connect, such as the hallway are not considered liveable and do not need an opening window or door.

Each window, door , or the skylight requirements for them to be in a position open to the outside, but remain at an open angle in order to allow the circulation of fresh air and ventilation.

All kitchens and bathrooms, and any other area in your house that houses shower, bath cooker or any other moisture-producing item will require suitable extractor fans that are vented out to the outside. The Healthy Homes Assessment service will make sure there is sufficient air circulation in every living space that includes extractor fans that are suitable in areas of high moisture.

Insulation Parkvale

The insulation of the ceiling and underfloor is required for all rent homes from 1 July 2019. Property managers and landlords have to make sure that the insulation is up to standards that are in line with the latest quality. In certain situations, the old ceiling insulation as well as insulation within the subfloor space might need to be topped up or replaced.

A properly insulated home will help to control condensation and lower the chance of mould and dampness and also makes much easier to allow the household to keep the heat.

Insulation needs to meet the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance, and is a measure of how well insulation is able to resist heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 and underfloor R 1.3

Parkvale Moisture Ingress & Drainage

Protecting your rental property from water damage isn’t only about the inside of the building; you have to ensure there is somewhere for surface, rain or ground water, and to prevent it from getting into the building. When it concerns damp and moisture it is usually the concerns you don’t notice that can become a big problem and cause the property to suffer and affecting your tenant’s health.

Rental properties should have effective drainage to get rid of storm water, surface water and ground water, including the proper outfall or runoff. Making sure that water is able to go, and that it doesn’t sit beneath buildings is a vital aspect of making sure your property is dry.

In addition to an irrigation system to stop water ingress, if the property has an enclosed space between your floor and the surface, a ground moisture barrier must be installed if it is reasonably practicable to do so.

Ground moisture barriers are generally made of polythene and is laid on top of the ground, in order to block any moisture from the ground from rising into the home. It also helps prevent water damage to the floor insulation.
