Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed for a Pakowhai rental property, all Healthy Homes compliance items need to be finished within 90 days.

When Do I need to meet the Healthy Homes Standards?

Pakowhai Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory to all Pakowhai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will apply to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts can lead to dropping temperatures within homes. A cold home will cost more to heat, which means wasting energy and incurring higher costs.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the sound of a clear draught emanating out of a hole or gap and you are able to feel it, it’s most likely a gap or hole which needs sealing in somehow. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that allow air to enter or exit of the home require to be sealed. For example, if the open fireplace isn’t being used, it can cause draughts and should be shut from. Landlords and property managers are responsible for ensuring that such draughts are squelched as far as possible.

You don’t require to block off holes or gaps that are part of the building. Heating Pakowhai

Rental properties in Pakowhai should have a permanent source of heat which can warm the living room to at least 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

In some instances, like small apartments the smaller fixed electric heater could be enough.

If your living space already has a fixed heating source, such as the heat pump, it might just require a top up to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Pakowhai

Every living space in a rental property must include at least one open doors or windows to offer natural airflow. In addition, high moisture spaces like kitchens and bathrooms should have an externally vented extractor to eliminate moisture.

A ventilation standard is all about understanding that dried air can be easier to heat, and that an apartment that is well-ventilated is less likely to grow mould and damp.

Living rooms, bedrooms, kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces such as the hallway aren’t considered living spaces and therefore don’t need an opening door or window.

Each window, door or skylight needs for them to be in a position open to the outside, but remain set in an opening position in order to allow to circulate fresh air as well as air flow.

Insulation Pakowhai

Insulation for underfloor and ceilings is required for all rent houses since 1 July 2019. Property managers and landlords should make sure the insulation meets the new quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.
