Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed contract is signed on a Pakowhai rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for the Pakowhai rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy contract, there could be an additional fine or violation fee.

Pakowhai Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement in all Pakowhai and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with the Healthy Homes Standard that apply or will be applied throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

Heating Pakowhai

Rental properties in Pakowhai require a reliable source of heating that can warm the main or largest living space to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity and have the minimum required heating capacity for the main living room. If your living space already has a central heating source, like the heat pump, it might just need some additional energy in order to comply with the standards. Some types of heaters can’t be used to achieve the standard because they’re expensive, inefficient or unsafe to operate.

Ventilation Pakowhai

Every living space in the rental property should have at least one openable windows or an exterior door to provide natural ventilation. Furthermore, moist areas such as kitchens and bathrooms should be equipped with an venting fan outside to remove moisture.

All landlords and property managers should ensure the insulation meets standards that are in line with the latest quality.
