Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Pakowhai rental property, all Healthy Homes compliance work must be finished inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on the Pakowhai rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager does not supply the information requested within 21 days from receiving the request, they can be issued an infringement notice and be fined as high as $750.

Additionally, there is also a fine of approximately $900 for landlords or property managers that provide false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is listed on the tenancy agreement as the one who is renting the property, so it could be the name of the landlord as well as the company that manages the property.

Pakowhai Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Pakowhai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with each Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Heating Pakowhai

Pakowhai rental properties should have a permanent source of heat which can warm the living space to a minimum of 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to determine if your current installed heater(s) are sufficient or whether you will need to ‘top up’ with an additional heater. If the heating you offer is an electric heater or heat pump, it needs to be equipped with the thermostat. This will help make the heating more consistent and efficient. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, like small apartment buildings an electric, fixed heater may be sufficient.

If your main living space already has a fixed heating source such as heat pumps, it could require an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality because they’re inefficient, unaffordable to operate or unsafe to operate.
