Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed for a Meeanee rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Meeanee rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager does not provide the information requested within 21 days from getting the notice, the tenant will receive an infringement notification and be fined upto $750.

Furthermore, there’s an additional fine of as much as $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible to pay this fine is the one who is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be current when the tenancy agreement is executed, and it is updated throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to remember that landlords who have multiple rental properties could face even higher fines for non-compliance. When do I need to be in compliance with my Healthy Homes Standards?

Meeanee Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Meeanee and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Meeanee rental properties need to have a stable source of heat that can heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs that it be permanently fixed (i.e., not portable) with at least 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are adequate or whether you will require to "top-up" with a new heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump it must have the thermostat. This makes the heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces an electric, fixed heater could be enough.

If your living space already has a fixed heating source like an air conditioner, it might just need a top up in order to comply with the standards. Some types of heaters can’t be used to achieve the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Meeanee

Every living space in a rental property must contain at minimum one open window or exterior door to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

The insulation of the ceiling and underfloor is required for all rent houses since July 1, 2019. Property managers and landlords must ensure that the insulation is in line with this new quality.
