Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Meeanee rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Meeanee rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager does not provide the necessary information within 21 days from having received the inquiry, they can receive an infringement notice and be fined upto $750.

Additionally, there is also a fine of up to $900 for property owners or property managers who provide a false or misleading Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It is also crucial to note that a landlord who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Meeanee Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required in all Meeanee and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with any Healthy Homes Standards that apply or will be in force to their rental properties.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Rental properties in Meeanee should have a permanent source of heating that can heat the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest days of the year.
