Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Meeanee rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

As of 1st July 2021, if a new or renewed tenancy is signed on the Meeanee rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to provide the information requested within 21 days from receiving the request, they will be issued an infringement notice and be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be current when the tenancy contract is signed, and ideally it should be maintained through the tenancy period as associated work has been completed.

It’s crucial to keep in mind that landlords with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for severe breaches. Landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.

Meeanee Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory in all Meeanee and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
