Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Marewa rental property, all Healthy Homes compliance items have to be done within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Marewa rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy contract, there could be an additional penalty or infringement fee.

If the property manager fails to provide the required information within 21 days of having received the inquiry, they may receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as being the person renting the property It could also be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current when the tenancy agreement is signed, and ideally it is updated through the tenancy period as related work is completed.

It is crucial to remember that landlords with multiple rental properties could face additional fines for non-compliance. The highest penalties are given only for serious breaches. Landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Marewa Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Marewa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform to the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Marewa

Draughts may lead to dropping temperatures within houses. A draughty house will cost more to heat, which means wasting energy and resulting in higher bills.

If a draught can be perceived as a result of gaps or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air coming in or an unobstructed draught coming out of a hole or gap, then it is most likely a gap or hole that requirements sealing in somehow. Cracks and gaps that are large should be stopped permanently. Gaps greater than 3mm that allow air in or out into the home require the sealing. For example, if an open fireplace isn’t in use it can cause draughts and should be blocked from. Landlords and property managers are responsible for making sure that such draughts are squelched whenever imaginable.

There is no need to block off gaps or holes in the construction. For instance, small gaps around windows and doors could be required to allow movement of the structure when the home gets warmer and cooler, in order to let them be closed and opened instead of than being stuck. Adequate heaters are important to ensure healthy homes

Heating Marewa

Rental properties in Marewa need to have a stable source of heating that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs to remain fixed (i.e., not portable), at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity for the main living space. Ventilation Marewa

Insulation for underfloor and ceilings is required on all rental houses since 1 July 2019. All landlords and property managers must make sure that the insulation meets current standard.
