Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Marewa rental property, all Healthy Homes compliance tasks have to be completed within 90 days.

As of 1st July 2021, when a new, renewed or varied Tenancy is signed for a Marewa rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, it could result in an additional fine or violation fee.

If the landlord or property manager fails to provide the information requested within 21 days from having received the inquiry, they could receive an infringement letter and be fined upto $750.

Additionally, there is also a penalty approximately $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person who is liable to pay this fine is the one who is named on the tenancy contract as the person who is letting the property and it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s important to be aware that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are given only for serious violations. Those who have six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Marewa Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Marewa and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Draughts may lead to dropping temperatures within homes. A cold house costs more to heat, which means wasting money and energy.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the air is clear out of a hole or gap that is, it is most likely a gap or crack that requirements sealing in some way. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that let air into or out within your house require seals. For instance, if an open fireplace is not in use, it may cause draughts and should be blocked off. Landlords and property managers are accountable for ensuring that draughts from the fireplace are removed whenever possible.

There is no need to block off holes or gaps in the construction. Heating Marewa

Marewa rental properties should have a permanent source of heat which can warm the living area to at minimum 18degC, even during the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs that it be permanently fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine if the existing permanent heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump it requirements to have a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments, a smaller fixed electric heater may be sufficient.

If the main living room already has a fixed heating source, such as the heat pump, it might need an upgrade to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard as they are either inefficient, unaffordable to operate and/or unsafe to run.

The insulation of the ceiling and underfloor is mandatory to all rental homes as of July 1st, 2019. Property managers and landlords are required to make sure that the insulation is in line with the new quality.
