Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Marewa rental property, all Healthy Homes compliance work must be completed within 90 days.

The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed, and ideally it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to remember that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 in hearing claims.

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory throughout Marewa and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records of their the compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
