Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Maraenui rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Maraenui rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they live in. If the the property manager doesn’t supply the information requested within 21 days from receiving the request, they can receive an infringement notification and be fined upto $750.

In addition, there’s an additional fine of as much as $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement needs to be accurate when the tenancy agreement is signed. It is updated throughout the tenancy as any related work is completed.

It is also crucial to note that landlords who have multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved for severe breaches, and landlords with more than six properties could be fined as high as $50,000, and as much as $100,000 in hearings.

Maraenui Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Maraenui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the conformance to the Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Maraenui

Maraenui rental properties should have a permanent source of heat that is able to heat the main or largest living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements to remain fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living room. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater might be enough.

If your living space already has a central heating source, such as an air conditioner, it may require some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be used to comply with the standard as they are either costly, not affordable to run, or are unsafe to operate.

Ventilation Maraenui
