Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Maraenui rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the required information within 21 days from receiving the request, they could receive an infringement letter and be fined as high as $750.

In addition, there’s also a fine of up to $900 for landlords or property managers providing a false or misleading Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the property management company.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any associated work has been completed.

It’s also crucial to note that a landlord who have multiple rental properties may receive additional fines for non-compliance. The highest penalties are given for severe breaches. Landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Maraenui Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Maraenui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applied to your rental home.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts can lead to lower temperatures in houses. A cold house is more expensive to heat, resulting in wasted energy and increased bills.

If a draught can be felt from unreasonable gaps or holes the area needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air entering or an unobstructed draught coming from a hole or gap, then it is likely a crack or an opening that requirements sealing in any way. Cracks and gaps that are large should be permanently stopped. Gaps greater than 3mm that allow air in or out of the home need seals. For instance, if an open fireplace isn’t being used, it could cause draughts, and should be shut off. Property managers and landlords are accountable for ensuring that these draughts are stopped in the maximum extent possible.

You don’t need to block off gaps or holes in the building. For example, tiny gaps around windows and doors could be necessary to allow for movement within the structure as the house warms and cools in order to let them be opened and closed rather instead of being stuck. Heating Maraenui

Rental properties in Maraenui must have a fixed heating source that can heat the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to be fixed (i.e. not portable), at least 1.5 kW of heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are adequate or whether you will need to "top-up" by adding a second heater. Unflued combustion and open fire heaters like the portable LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it must include a thermostat. This makes the heating more consistent and efficient. In most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, like small apartment buildings the smaller fixed electric heater could be enough.

If your main living space already has a central heating source like the heat pump, it may need some additional energy to make sure it meets the requirements. Some types of heaters can’t be utilised to meet the quality as they are either costly, not affordable to run, and/or unhealthy to run.

Ventilation Maraenui
