Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with each of Healthy Homes Standards within the period of time expected can lead to an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the information requested within 21 days of getting the notice, the tenant could receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord as well as the property management company.

Mangateretere Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Mangateretere and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate conformance with any Healthy Homes Standards that apply or will apply to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Mangateretere

Mangateretere rental properties must have a fixed source of heating which can warm the living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

For most homes, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In some instances, like apartments with small spaces, a smaller fixed electric heater could be enough.

If the main living room already has a fixed heating source, such as heat pumps, it could require some additional energy to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either costly, not cost-effective to run, and/or unsafe to run.
