Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.
Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement it could result in an additional penalty or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager does not provide the information requested within 21 days of getting the notice, the tenant could be issued an infringement notice and be fined as high as $750.
In addition, there’s also a penalty up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is named on the lease agreement as being the person who is letting the property which could be the name of the landlord, or the property management company.
The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as necessary work related to it’s finished.
It is also crucial to remember that a landlord who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are given for serious breaches. Landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.
In the end, a failure to meet requirements of Healthy Homes requirements can hit your wallet and result in large fines in addition to still being required to adhere to the regulations.
