Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Kotemaori rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on the Kotemaori rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to supply the necessary information within 21 days from being informed of the request, they may receive an infringement letter and be fined up to $750.

In addition, there is an additional fine of approximately $900 for property owners or property managers who offer a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible to pay this fine is the one who is named on the tenancy agreement as the one who is renting the property which could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and should be maintained through the tenancy period as associated work has been completed.

It is also important to keep in mind that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved only for serious breaches, and landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearings.

Kotemaori Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Kotemaori and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their compliance with any Healthy Homes Standard that apply or will apply to your rental home.

From 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Kotemaori rental properties should have a permanent source of heating that can warm the largest or main living room to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.
