Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Kotemaori rental property, all Healthy Homes compliance work must be done within 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on a Kotemaori rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager does not provide the information requested within 21 days from having received the inquiry, they could receive an infringement letter and be fined upto $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the person who is who is letting the property It could also be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as necessary work related to it is finished.

It’s also important to note that landlords who manage multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearings.

Kotemaori Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory to all Kotemaori and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Kotemaori

Rental properties in Kotemaori need to have a stable source of heat that is able to heat the living room to at least 18degC, even during the coldest days of the year.
