Rental Property Healthy Homes Fines
Fines for Failing to Comply
Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Kingsley-Chatham rental property, all Healthy Homes compliance items have to be finished inside of 90 days.
From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for a Kingsley-Chatham rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to adhere to any of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or amended tenancy agreement it could result in an additional penalty or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the information requested within 21 days of being informed of the request, they can receive an infringement notice and be fined as high as $750.
Additionally, there is also a penalty approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the person who is who is letting the property and it could be the landlord’s name or the property management company.
All information in the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any associated work has been completed.
It is also crucial to remember that a landlord who own multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved only for serious breaches. Landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearings.
In the end, a failure to comply with the Healthy Homes requirements can hit your bank account and result in huge fines, in addition to having to continue to comply. Do not risk your rental property, contact us today and arrange to have a home assessment performed on the rental property you are renting.
