Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Kingsley-Chatham rental property, all Healthy Homes compliance items have to be done by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied Tenancy is signed for the Kingsley-Chatham rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Additionally, there is an additional fine of approximately $900 for property owners or property managers who offer a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is identified on the tenancy contract as the person leasing the property out, so it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be accurate when the tenancy agreement is signed. It should be maintained during the entire tenancy, as necessary work related to it is finished.

It’s crucial to be aware that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Kingsley-Chatham Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement to all Kingsley-Chatham and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
