Healthy Homes Assessment Services

Did you know that the Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to ensure that their Karamu rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rentals are required to be completely certified by 1 July 2024.

Inability to meet the standards in the Healthy Homes Standards is a breach of the Residential Tenancies Act 1986, and any landlord found to not in compliance could face fines of up to $7,200 plus additional healthier homes associated fines.

Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Karamu rental property, all Healthy Homes compliance work have to be completed within 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on the Karamu rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to supply the necessary information within 21 days from having received the inquiry, they will receive an infringement notification and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is listed on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement needs to be correct when the tenancy contract is signed. It is updated through the tenancy period as related work is completed.

It’s important to be aware that a landlord who own multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down only for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Karamu Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory for all Karamu and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the conformance to any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts may lead to lower temperatures in households. A damp house costs more to heat, which results in wasting energy and incurring higher costs.

What are unreasonable gaps or holes?

Large cracks and gaps should be fixed permanently. Any gaps greater than 3mm that let air into or out within your house need sealing. For example, if the open fireplace isn’t in use it could cause draughts, and should be blocked from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as far as possible.

You don’t require to block up intentional holes or gaps in the building. For instance, small gaps around windows and doors could be necessary to allow for movement within the building as the house warms and cools to allow them to be opened and closed rather instead of being stuck. Heating Karamu

Rental properties in Karamu need to have a stable source of heating that can warm the living area to at minimum 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs for it to be permanent (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required for the main living space. A Heating Assessment Tool may be used to check if the current fix heater(s) are adequate or if you’ll require to top up with a new heater. If the heating system you offer is an electric heater (or heat pump), then it must include an thermostat. This makes the heating more reliable and efficient. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. Insulation Karamu

Ceiling and underfloor insulation has been compulsory in all rental houses since July 1, 2019. All landlords and property managers must ensure that the insulation is in line with this new standard. In some instances, old ceiling insulation as well as insulation within the subfloor space may need to be filled with or replaced.
