Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Havelock North Central rental property, all Healthy Homes compliance items must be taken care of within 90 days.

As of 1st July 2021, when a new, renewed or varied contract is signed on the Havelock North Central rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the necessary information within 21 days of receiving the request, they could receive an infringement notification and be fined as high as $750.

In addition, there’s also a penalty up to $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property It could also be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement requirements to be accurate at the time that the tenancy agreement is completed, and should be maintained throughout the tenancy as any relevant work gets completed.

It is crucial to note that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in the case of hearing claims.

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory in all Havelock North Central and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

What are unjustifiable gaps or holes?

If you can feel external air coming in or the sound of a clear draught emanating from a crack or a gap or crack, then it’s likely a crack or an opening that requirements sealing in somehow. Large cracks and gaps should be sealed permanently. Any gaps greater than 3mm that let air into or out within your home require the sealing. Heating Havelock North Central

Havelock North Central rental properties should have a permanent heating source which can warm the{ main or largest|| largest or main| principal or the biggest} living space to a minimum of 18degC, even during the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to remain fixed (i.e. not portable), at least 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity to heat the living space in general. For most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If the living area already has a permanent heating source, such as heat pumps, it could need a top up to meet the standards. Certain kinds of heaters cannot be used to meet the standard as they are either not efficient, cost prohibitive to operate or are unsafe to operate.

Ventilation Havelock North Central
