Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Haumoana rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on a Haumoana rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager is unable to provide the necessary information within 21 days from receiving the request, they will be issued an infringement notice and be fined upto $750.

Furthermore, there’s also a fine of up to $900 for landlords or property managers providing a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as the person who is renting the property which could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be correct before the tenancy agreement can be completed, and should be kept updated through the tenancy period as necessary work related to it is finished.

It’s also important to note that landlords who manage multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved for serious breaches, and landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Haumoana Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Haumoana and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove conformance with all Healthy Homes Standard that apply or will apply during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts can lead to less temperature in households. A damp home costs more to heat, meaning wasting energy and increased bills.

If a draught could be noticed from gaps that are not adequate or holes or holes, it needs to be closed.

What are unreasonable gaps and holes?

If you can feel external air entering or the air is clear from a crack or a gap that is, it’s likely to be a gap or hole that needs sealing in any way. Heating Haumoana

Haumoana rental properties should have a permanent source of heating that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements to be fixed (i.e., not portable), at minimum 1.5 kW in heating capacity and have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to check if the current fixed heater(s) are adequate or if you’ll need to "top up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered to be safe heating options under those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, then it must include a thermostat. This will help make the heating more consistent and efficient. In most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may suffice.

If the main living room already has a permanent heating source, like the heat pump, it may require an update in order to comply with the standards. Some types of heaters can’t be used to achieve the quality since they’re either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Haumoana

Each living space within a rental property has to contain at minimum one open door or window to provide natural ventilation. In addition, humid areas such as kitchens and bathrooms should be equipped with an venting fan outside to remove moisture.

This ventilation quality is all about recognising how dry air is more easy to heat and that a property that is well ventilated will be less prone to developing mould and damp.

Living rooms, bedrooms, kitchens, and dining areas are all considered living spaces. Spaces that connect, such as the hallways are not liveable and therefore do not need an opening window or door.

Each window, door , or Skylight needs at least to open to the outside, and stay at an open angle, allowing for fresh air circulation and ventilation.

Ceiling and underfloor insulation has been compulsory for all rent houses as of July 1st, 2019. Property managers and landlords are required to make sure the insulation meets this new quality. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be topped up or replaced.
