Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Hastings rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

As of 1st July 2021, when a new or renewed contract is signed on the Hastings rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the necessary information within 21 days of being informed of the request, they can receive an infringement letter and be fined upto $750.

Furthermore, there’s also a penalty of approximately $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be correct when the tenancy contract is executed, and it should be kept updated during the entire tenancy, as relevant work gets completed.

It’s crucial to remember that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are handed down for serious violations. Those who have six or more properties can receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Hastings Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory to all Hastings and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with the Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Adequate heaters are important for well-being homes

Heating Hastings

Rental properties in Hastings must have a fixed source of heat that is able to heat the largest or main living space to at least 18degC, even during the coldest days of the year. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

The insulation of the ceiling and underfloor is required on all rental homes as of July 1st, 2019. Property managers and landlords have to ensure the insulation meets the new quality.
