Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Hastings Central rental property, all Healthy Homes compliance items must be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied contract is signed on the Hastings Central rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

It’s also crucial to remember that a landlord who manage several rental properties can face additional fines for non-compliance. The highest penalties are reserved only for serious breaches. Landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

Hastings Central Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory in all Hastings Central and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applied during the tenancy of their rental properties.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.
