Healthy Homes Assessment Services

Did you not know that Healthy Homes Standards came into in force on July 1, 2021? Landlords now have to make sure that their Greenmeadows rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals must be fully compliant by 1 July 2024.

Failure to fulfill the requirements in the Healthy Homes Standards is a breach under the Residential Tenancies Act 1986, and landlords who are not in compliance could face fines of up to $7,200 plus additional healthier homes related fines.

Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Greenmeadows rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on a Greenmeadows rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not provide the information requested within 21 days from receiving the request, they may receive an infringement notification and be fined as high as $750.

In addition, there is also a penalty of approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is renting the property and it could be the name of the landlord or the property management company.

All information in the Compliance Statement requirements to be accurate when the tenancy contract is signed, and ideally it should be kept updated throughout the tenancy as any related work is completed.

It is also important to note that landlords with multiple rental properties could face greater penalties for non-compliance. The most severe penalties are given only for serious breaches. Landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

When Do I require to meet The Healthy Homes Standards?

Greenmeadows Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement in all Greenmeadows and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Greenmeadows

Draughts can lead to less temperature in homes. A humid house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught can be perceived as a result of gaps or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole, then it is probably a gap or an opening that requirements sealing in any way. Cracks and gaps that are large should be stopped permanently. Cracks that are greater than 3mm and allow air in or out of the home need to be sealed. In the case of an open fireplace isn’t being used, it could cause draughts, and should be sealed from. Landlords and property managers are accountable for making sure that these draughts are stopped whenever imaginable.

There is no need to block off gaps or holes in the construction. For instance, small gaps around windows and doors could be necessary to allow for the movement of the building when the household warms and cools to allow them to be closed and opened instead of than being stuck. Adequate heaters are important to ensure well-being homes

Heating Greenmeadows

Rental properties in Greenmeadows must have a fixed source of heating that is able to heat the living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to determine if the permanent heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters aren’t considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it should include the thermostat. This makes your heating more consistent and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, such as small apartments the smaller fixed electric heater may be sufficient.

If your living space already has a fixed heating source like a heat pump, then it may require some additional energy to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality because they’re not efficient, cost prohibitive to operate or are unsafe to operate.

Ventilation Greenmeadows

Each living space within a rental property has to contain at minimum one open door or window to offer natural airflow. In addition, high moisture areas such as kitchens or bathrooms should have an venting fan outside to eliminate moisture.

Insulation Greenmeadows

Insulation for underfloor and ceilings is required to all rental houses from 1 July 2019. Property managers and landlords have to ensure the insulation meets the new quality. In some cases, current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.

A house that is well-insulated will reduce the risk of condensation and lessen the likelihood of mould and damp, and it will make it easier to the home to retain heat.
