Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords must make sure their Greenmeadows rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Greenmeadows rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Greenmeadows rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager is unable to supply the information requested within 21 days from receiving the request, they may receive an infringement notification and be fined upto $750.

In addition, there is also a penalty of up to $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person letting the property out It could also be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is completed, and should be maintained through the tenancy period as associated work has been completed.

It’s also important to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down only for serious violations. Those who have more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

When Do I need to meet the Healthy Homes Standards?

Greenmeadows Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement for all Greenmeadows and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to all Healthy Homes Standard that apply or will be applicable during the tenancy of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Greenmeadows

Rental properties in Greenmeadows should have a permanent source of heating which can warm the living area to at minimum 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

Ceiling and underfloor insulation is required on all rental homes as of July 1st, 2019. Property managers and landlords are required to ensure the insulation meets standards that are in line with the latest standard.
