Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Greenmeadows rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on the Greenmeadows rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Additionally, if a existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the necessary information within 21 days from having received the inquiry, they could receive an infringement letter and be fined upto $750.

Furthermore, there’s also a penalty of up to $900 for landlords or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be up-to-date when the tenancy agreement is completed, and should be kept updated during the entire tenancy, as associated work has been completed.

It’s crucial to be aware that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

It is clear that failure to adhere to requirements of Healthy Homes requirements can hit your bank account with massive fines as well as having to continue to comply. Don’t take a chance with your rental property call us now and arrange to have a home assessment performed on the rental property you are renting.

Unreasonable Gaps & Holes

Draught Stopping Greenmeadows

Draughts can lead to low temperatures inside homes. A cold home is more expensive to heat, which completed jobs in wasting energy and increased bills.

If a draft can be felt through gaps that are too large or holes the area requirements to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air coming in or the air is clear from a hole or gap or crack, then it is most likely a gap or an opening that needs sealing in some way. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that let air in or out within your house require sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and should be blocked from. Property managers and landlords are accountable for making sure that draughts from the fireplace are removed in the maximum extent imaginable.

There is no require to block holes or gaps in the building. For instance, small gaps around doors and windows might be necessary to allow movement of the building as the house is heated and cools to allow them to be opened and closed rather than securing. We will inspect the windows and doors in an Healthy Homes assessment of your rental property.

Heating Greenmeadows

Greenmeadows rental properties must have a fixed source of heating which can warm the main or largest living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to determine whether your current fix heater(s) are adequate or if you’ll require to ‘top up’ by adding a second heater. Open fires as well as unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be safe heating options under those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it requirements to be equipped with the thermostat. This makes your heating more consistent and effective. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like apartments with small spaces the smaller fixed electric heater may be sufficient.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it may require some additional energy in order to comply with the standards. Certain kinds of heaters cannot be utilised to meet the quality because they’re expensive, inefficient and/or unhealthy to run.

Ventilation Greenmeadows

Every living space in a rental property must include at least one open windows or an exterior door to offer natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms should be equipped with an externally vented extractor to eliminate moisture.

It is the ventilation standard is all about recognising the fact that the dry atmosphere is much easier to heat, and that a property that is well ventilated will be less prone to developing mould and damp.

Bedrooms, living rooms, kitchens, and dining areas are considered to be liveable spaces. Connecting spaces like the hallway aren’t considered liveable and therefore don’t need an opening door or window.

Every window, door or skylight needs for them to be in a position open to the outside while remaining set in an opening position to allow for fresh air circulation and air flow.

All bathrooms and kitchens as well as any other space in your house that houses a bath, shower or cooktop, or any other humidity-generating items will require proper extractor fan systems that are vented towards the outside. The Healthy Homes Assessment service will ensure that there is sufficient ventilation in each livable space, including suitable extractor fans in high moisture areas.

Insulation Greenmeadows

The insulation of the ceiling and underfloor is required to all rental homes since July 1, 2019. All landlords and property managers should make sure that the insulation meets the new standard. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.

A house that is well-insulated will help to control condensation and reduce the chances of mould and dampness, as well as making an easier task to the house to keep warmth.

Insulation requirements to be in compliance with the R-values that are appropriate for your region.

The "R" refers to thermal resistance, and is a gauge of how well insulation can withstand heat flow. The more R-value is higher, the higher the quality of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 and underfloor R 1.3

Greenmeadows Moisture Ingress & Drainage

Protecting your rental property from the effects of moisture isn’t just a matter of what’s inside the building; you have to make sure there is somewhere for rain, surface and underground water to flow and also stop it from getting inside. When it concerns damp and moisture it is frequently not apparent that it can cause a lot of trouble that can cause the property to suffer and affecting your tenant’s health.

Rental properties should have efficient drainage to eliminate floodwaters, surface water, and groundwater, with an appropriate outfall or runoff. Making sure the water has a place to go and that it isn’t allowed to remain beneath buildings is an essential part of maintaining your property’s dry.

Alongside a drainage system to prevent the ingress of moisture, if your apartment has an enclosed gap between your floor and soil, a ground-water barrier must be installed if it’s reasonably practicable to install it.

An underground moisture barrier typically made of polythene and is laid on top of the ground, to block any moisture in the ground from rising into the building. It also helps to prevent any damage to your underfloor insulation.
