Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Frasertown rental property, all Healthy Homes compliance items must be finished within 90 days.

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Frasertown rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.

The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property It could also be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be accurate when the tenancy agreement is signed. It should be maintained through the tenancy period as relevant work gets completed.

It’s also important to keep in mind that landlords who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Frasertown Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory for all Frasertown and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be in force to the rental property.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.

What are unreasonable gaps or holes?

Heating Frasertown

Frasertown rental properties require a reliable source of heating that is able to heat the{ main or largest|| largest or main| principal or the biggest} living space to a minimum of 18 degrees Celsius, even on the winter coldest days.
