Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Frasertown rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on the Frasertown rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there could be an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to provide the information requested within 21 days of being informed of the request, they will receive an infringement letter and be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is whoever is named on the lease contract as the person leasing the property out It could also be the name of the landlord, or the property management company.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy contract is signed, and ideally it is updated throughout the tenancy as any related work is completed.

It’s important to note that a landlord who manage several rental properties can face more severe penalties for not complying. The harshest penalties are given only for serious violations. Those who have six or more properties can be fined up to $50,000, and even as high as $100,000 in hearing claims.

Frasertown Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement in all Frasertown and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to each Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

From July 1st 2021

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Rental properties in Frasertown require a reliable heating source which can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

If the living area already has a central heating source, such as the heat pump, it could need an update to ensure it meets the requirements. Some types of heaters can’t be used to achieve the standard as they are either not effective, cost prohibitive to operate or unsafe to operate.
