Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Flaxmere rental property, all Healthy Homes compliance items need to be done within 90 days.

The person responsible to pay this fine is the one who is named on the lease agreement as the one who is letting the property out, so it could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any relevant work gets completed.

It’s also important to keep in mind that a landlord who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Flaxmere Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Flaxmere and New Zealand rental homes where it’s reasonably practicable to put in.

  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
