Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Fernhill rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

Fernhill Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement to all Fernhill and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applied during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Fernhill

Rental properties in Fernhill should have a permanent heating source that is able to heat the largest or main living room to at least 18degC, even on the coldest days of the year. If the main living room is already equipped with a fixed heating source such as heat pumps, it could need an upgrade in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality because they’re inefficient, unaffordable to operate or unsafe to operate.
