Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Fernhill rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is identified on the tenancy contract as the person leasing the property out which could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be correct before the tenancy agreement can be signed, and ideally it should be maintained throughout the tenancy as any associated work has been completed.

It is also important to note that landlords who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Fernhill Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Fernhill and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with each Healthy Homes Standards that apply or will be applicable to their rental properties.

Starting 1 July 2021

Rental properties in Fernhill should have a permanent source of heat that can heat the largest or main living space to a minimum of 18degC, even during the winter coldest days. For most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like small apartment buildings an electric, fixed heater may suffice.

If your main living space already has a permanent heating source like heat pumps, it might just require a top up to ensure it meets the requirements. Some types of heaters can’t be used to achieve the standard since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Fernhill

Ceiling and underfloor insulation is mandatory on all rental houses since 1 July 2019. All landlords and property managers should make sure that the insulation meets the new standard.
