Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on an Eskdale rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for an Eskdale rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or the property manager doesn’t provide the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is whoever is named on the lease agreement as the one who is renting the property and it could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance requirements to be current when the tenancy contract is completed, and should be kept updated throughout the tenancy as any relevant work gets completed.

It’s also important to be aware that a landlord who own multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory in all Eskdale and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with the Healthy Homes Standards that apply or will be applicable throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.
