Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for an Eskdale rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there could be an additional penalty or infringement fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from receiving the request, they could receive an infringement notice and be fined upto $750.
In addition, there is also a penalty as much as $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord, or the property management company.
All the information on the Compliance Statement needs to be accurate when the tenancy contract is completed, and should be kept updated throughout the tenancy as any necessary work related to it’s finished.
It is also crucial to be aware that landlords who manage multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for the most serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.
