Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Bay View rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

If the landlord or property manager does not provide the necessary information within 21 days from being informed of the request, they will receive an infringement notice and be fined up to $750.

In addition, there’s also a fine of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is named on the lease agreement as the person who is renting the property It could also be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be up-to-date when the tenancy contract is executed, and it should be maintained throughout the duration of the tenancy when any related work is completed.

It is important to be aware that a landlord with several rental properties can face even higher fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Bay View Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory in all Bay View and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Adequate heaters are important to ensure well-being houses

Heating Bay View

Bay View rental properties require a reliable source of heating that can warm the largest or main living room to at least 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to check if your current fix heater(s) are adequate or whether you will need to "top-up" with an additional heater. Open fires as well as unflued combustion heaters such as portable LPG bottle heaters are not considered acceptable heating options for the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump it must include the thermostat. This will make the heating more uniform and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments the smaller fixed electric heater may suffice.

If the living area is already equipped with a fixed heating source like the heat pump, it might need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Bay View

Bathrooms, kitchens, and any other area in your home that has a bath, shower and cooktop or another moisture-producing item will require appropriate extractor fans that are vented towards the outside. Insulation Bay View

Ceiling and underfloor insulation is required for all rent houses as of July 1st, 2019. All landlords and property managers should make sure the insulation meets current quality. In some cases, an existing insulation on the ceiling or in the sub floor space may require to be filled with or replaced.

A well-insulated house can help control condensation and lower the chance of dampness and mould, and will also make more easy to allow the house to hold heat.

In addition to an irrigation system to stop moisture ingress, if your apartment has an enclosed gap between floorboards and surface, a ground moisture barrier must be put in place when it is reasonably practicable to install it.

Ground moisture barriers are generally made of polythene and is laid on top of the ground to stop any moisture from the ground from entering the building. It also helps prevent any damage to your underfloor insulation.
