Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied contract is signed on an Anderson Park rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.
From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for an Anderson Park rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy contract, it could result in an additional penalty or infringement fee.
Anyone can request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the required information within 21 days of having received the inquiry, they will receive an infringement notification and be fined as high as $750.
Furthermore, there’s also a fine of up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is identified on the tenancy contract as the person who is letting the property and it could be the name of the landlord, or the property management company.
All information in the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as necessary work related to it’s finished.
It is also important to be aware that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for the most serious breaches. Landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.
