Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on an Akina rental property, all Healthy Homes compliance items have to be done within 90 days.

From the 1st of July in 2021, if a new or renewed contract is signed on an Akina rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of having received the inquiry, they could receive an infringement letter and be fined up to $750.

Additionally, there is also a fine of up to $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the one who is leasing the property out It could also be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement requirements to be accurate when the tenancy agreement is executed, and it is updated throughout the duration of the tenancy when any necessary work related to it’s finished.

When will I require to be in compliance with the Healthy Homes Standards?

Akina Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Akina and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

If the living area already has a central heating source like heat pumps, it could need some additional energy in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality because they’re not effective, cost prohibitive to operate or are unsafe to operate.

Ventilation Akina
