Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on an Akina rental property, all Healthy Homes compliance work have to be done within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed lease is entered into on the Akina rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to provide the required information within 21 days from receiving the request, they will receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as being the person who is letting the property It could also be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s crucial to keep in mind that landlords who manage multiple rental properties could face more severe penalties for not complying. The highest penalties are handed down only for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Akina Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement in all Akina and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with all Healthy Homes Standard that apply or will be in force throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

You don’t require to block off holes or gaps which are part of the construction. For instance, small gaps around doors and windows could be necessary to allow for movement of the building as the household gets warmer and cooler, so that they can still be opened and closed rather than sticking. Heating Akina

Rental properties in Akina need to have a stable source of heating which can warm the main or largest living space to at least 18degC, even during the most coldest days of the year. However, in certain instances like small apartments, a smaller fixed electric heater might be enough.

If the main living room already has a fixed heating source, such as a heat pump, then it may need an update to meet the standards. Certain types of heaters cannot be utilised to meet the quality because they’re expensive, inefficient or are unsafe to operate.

Ventilation Akina
