Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance items must be done within 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on the Ahuriri rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of receiving the request, they can be issued an infringement notice and could be fined up to $750.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is named on the lease contract as the person renting the property It could also be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is executed, and it is updated through the tenancy period as related work is completed.

It’s crucial to remember that a landlord with multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

When will I need to be in compliance with the Healthy Homes Standards?

Ahuriri Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement in all Ahuriri and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Ahuriri

Rental properties in Ahuriri must have a fixed source of heating which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to be fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living room.
