Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for an Ahuriri rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on the Ahuriri rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy contract, there may be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the information requested within 21 days of being informed of the request, they may receive an infringement notice and be fined as high as $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord, or the company that manages the property.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory in all Ahuriri and New Zealand rental homes where it’s reasonably practicable to install.

Heating Ahuriri

Ahuriri rental properties must have a fixed source of heating that can warm the main or largest living space to a minimum of 18degC, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e., not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters aren’t considered acceptable heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating or heat source, then it must include the thermostat. This will make the heating more uniform and efficient. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If your main living space already has a permanent heating source, such as an air conditioner, it could need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the quality because they’re expensive, inefficient and/or unsafe to run.
